JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-04-2019 Earlier the prayer for bail of the petitioner was rejected, firstly vide order dated 10.02.2017 passed in Cr. Misc. No. 2922 of 2017 with a direction to the learned court below to conclude the trial within a period of nine months and secondly vide order dated 24.01.2018 passed in Cr. Misc. No. 236 of 2018 with a direction to the learned court below to conclude the trial within a period of three months The petitioner seeks regular bail in connection with Dhanarua P.S. Case No. 488 of 2015, registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner is of providing pistol to the co-accused, who fired causing death of the deceased. Submission of learned counsel for the petitioner is

Having heard both sides, considering the facts and circumstances of the case and also considering the fact that the petitioner is custody for more than two years, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-X, Patna, in connection with Dhanarua P.S. Case No. 488 of 2015, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
