Petitioner seeks bail in a case registered for the offences punishable under Sections 406, 420, 467, 468, 471, 34 of the Indian Penal Code.

A cheque of Rs.27,285/- was issued in the name of petitioner for the work done by him, as Block Coordinator in the scheme of Swachh Bharat Mission. Allegation is that Figure-2 was put before the aforesaid figure and as such Rs.2,27,285/- was withdrawn by the petitioner. Submission of learned counsel for the petitioner is that the petitioner has already refunded Rs. Two Lacs, remaining amount was for the work done by the petitioner. Petitioner has got a criminal antecedent.

Patna High Court Cr.Misc. No.47901 of 2018 (2) dt.20-08-2018 2/2 Petitioner is in custody since 04.06.2018. Investigation of the case is complete against the petitioner.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Madhubani Town Police Station Case No.85 of 2016, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
