JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 04-07-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under section 401 and 414 and other allied sections of the Indian Penal Code.

It is alleged that 25 bundles of copper wire were seized buried underneath near the house of the petitioner and others. Learned counsel for the petitioner submits that copper was not recovered from this appellant and he has been framed in this case on mere suspicion. He next submits that he is also an accused in two other cases of 2006.

In the facts and circumstances of the cas,e as well as the fact that there is no direct evidence that it is the petitioner who buried copper wire with a view to conceal it, in the event of arrest/surrender, let the petitioner as mentioned above, be

Patna High Court Cr.Misc. No.25159 of 2016 (3) dt.04-07-2016 released on bail on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari East Champaran in Motihari Muffasil Police station Case No. 30 of 2016.
