JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-05-2020 The petitioner, who is a person of clean antecedents and is in custody since 31.01.2020 seeks bail in connection with G.O. Excise Case No. 140 of 2020, arising out of Ghanshyampur P. S. Case No. 23 of 2020 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It appears that 127.80 litres of liquor was recovered from the house of the petitioner.

It has been submitted that the seizure list does not bear his signature and this fact is an evidence of his false implication.

Regard being had to the nature of accusation

Patna High Court CR. MISC. No.16552 of 2020(2) dt.13-05-2020 2/2 against the petitioner and his period of custody and taking into account his clean antecedents, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned IInd Additional Sessions Judge cum Special Judge (Excise), Darbhanga in connection with G.O. Excise Case No. 140 of 2020, arising out of Ghanshyampur P. S. Case No. 23 of 2020.
