====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-08-2024 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the opposite party No. 2.

2. The petitioner apprehends his arrest in connection with Sadar P.S. Case No. 575 of 2022 registered under Sections 467, 468, 406, 420 and 34 of the Indian Penal Code.

3. The crux of the allegations as alleged in the F.I.R. is that petitioner in collusion with others took more than Rs. 15 lacs from informant and executed sale deed with regard to land of Khata No. 341, Khesra No. 1849, Area- 1.94

No.20122 of 2024(5) dt.21-08-2024 2/3 decimals, but later on, informant came to know that earlier sale deed had already been executed with regard to said piece of land by the accused persons to one Gayatri Devi and in this way, the accused persons cheated informant and misappropriated the entire consideration money.

Learned counsel appearing on behalf of the petitioner submits that from perusal of F.I.R., it is apparent that the dispute is with regard to sale and purchase of property which is purely civil in nature. Only with a view to settle a civil dispute and claim a criminal hue has been lent to a civil natured issue. Moreover, informant has got alternative remedy.

5. Learned A.P.P. for the State and learned counsel for the opposite party No. 2 vehemently opposed the prayer for bail.

6. Having considered the aforesaid facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the
