2. The petitioner seeks regular bail in connection with Sessions Trial No. 1216 of 2023, arising out of Shahpur P.S. Case No. 149 of 2012, dated 21.11.2012, lodged under Sections 304B, 301 and 34 of the Indian Penal Code, pending before the Court of Additional Sessions Judge-V, Danapur, District- Patna.

3. Learned senior counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected twice vide order dated 15.11.2022 passed in Cr. Misc. No. 27535 of 2022 and vide order dated 16.02.2024 passed in Cr. Misc. No. 45593 of 2023 respectively.

4. Senior counsel further submits that the petitioner has been in custody since 04.01.2022 and has clean criminal antecedents. He further submits that the trial has not been concluded, and only vide order dated 25.07.2025, a report has been called for to ascertain under what circumstances the

Patna High Court CR. MISC. No.21980 of 2025(4) dt.30-08-2025 2/3 accused, who is in custody since 04.01.2022, but charge has been framed on 26.03.2025. He further submits that the petitioner is ready to fulfil all the conditions whatsoever may be imposed upon him and is also willing to appear on each and every date fixed for trial. He also submits that keeping the petitioner in custody shall serve no purpose, hence, bail may be granted to the petitioner.

5. Learned APP for the State vehemently opposes the prayer for bail and submits that it is a unique case, which was lodged in the year 2012 bearing Shahpur P.S. Case No. 149 of 2012. He submits that the petitioner pursued bail only in the year 2022, and due to his delayed appearance of about 10 years, the trial has been delayed and could not be concluded. He further submits that the charge has been framed in the year 2025. He also submits that once bail is granted to the petitioner, the trial shall not be concluded.

6. After hearing the parties, it transpires to this Court that it is a unique situation wherein the case pertains to the year 2012, and the trial has not been concluded till date. It further transpires to this Court that the present case relates to Patna District.

7. It is the third bail application of the petitioner, and

For this reason, the Senior Superintendent of Police, Patna, is hereby directed to take necessary action by instructing the concerned SHO/IO to ensure the production of the charge-sheet witnesses before the Trial Court in connection with Sessions Trial No. 1216 of 2023, arising out of Shahpur P.S. Case No. 149 of 2012 at the earliest, so that the trial may be concluded within six months from the date of receiving of the order.

8. In the present facts and circumstances, at this stage, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for regular bail of the petitioner is hereby rejected.

The Registry is directed to transmit a copy of this order to the Senior Superintendent of Police, Patna, through fax, e-mail, or any other mode forthwith, and one copy shall also be provided to the learned A.P.P. so that he may communicate this order to the Senior Superintendent of Police, Patna at his level in this regard.
