2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 420, 406/34 of the Indian Penal Code.
3. It is a case of cheating. The FIR named accused persons including the petitioner took Rs. 12 lakhs from the informant and said that they shall multiply his amount by four times in two months. After some time, when the informant asked for his money, the accused persons did not give the same and started making excuses.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. There is no documentary proof with regard to the payment of Rs. 12 lakhs by the informant to the accused persons. It is also submitted that the alleged taken money of Rs. 12 lakh has not been recovered from conscious possession of the petitioner. The petitioner is languishing in judicial custody since 4.10.2023. Moreover, co-accused Niranjan Paswan has already been granted bail by this Court vide order dt. 26.04.2024 passed in Cr. Misc. No. 83821 of 2023. A statement has been made in para 3 of the petition that petitioner has got no criminal antecedent.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above
Patna High Court CR. MISC. No.21092 of 2024(4) dt.21-06-2024 3/3 named petitioner is directed to be released on bail after framing of charge, if not framed in connection with Laheri P.S. Case No. 616 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif.
