Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a and 26 of the Arms Act.

A firearm and cartridges were recovered from the bed of the petitioner. The petitioner was present in the house. Petitioner is in custody since 14.02.2018. Investigation of the case is complete. Petitioner has got a criminal antecedent. Submission is that the house is occupied by other members of the family, hence, recovery is not from conscious possession of the petitioner.

Considering the aforesaid fact, let the petitioner, above named, be released on bail after completion of eight

Patna High Court Cr.Misc. No.45475 of 2018 (2) dt.02-08-2018 2/2 months of custody on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Ahiyapur Police Station Case No. 152 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
