The petitioner seeks bail in a case for the offence registered under Sections 366(A) and 506/34 of the IPC. The prosecution story, in brief, is that on 14.05.2019 the daughter of the informant went to attend examination, but she did not return home. In course of search, he came to know that this petitioner kidnapped his daughter for the purpose of marriage and while the informant went at the house of this petitioner, accused persons abused and assaulted him. It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 14.09.2019. The petitioner has got no criminal antecedent. He

Patna High Court CR. MISC. No.15430 of 2020(2) dt.03-03-2020 2/2 has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The victim has been examined under Section 164 of Cr. P.C. She has denied the allegation made in the F.I.R. She has got married to the petitioner annexed as Annexure-2 to the petitioner. Hence, she has left house out of her own will.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Katihar, in connection with Kursela P.S.Case No. 98 of 2019. (Sudhir Singh, J) U.K./- U T
