JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-05-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Bathnaha P.S. Case No. 255 of 2019, registered under Section 30(a)(c) of he Bihar Excise Act, 2016.

The accusation is that on receiving secret information about unloading of illicit liquor at Haribela Braham Asthan, the informant along with other police officials reached there. On seeing the police personnel, three persons present there started to flee away, even on chase, they succeeded to flee away. On search of one house, several bottles of Indian made foreign liquor in the volume of 1750.92 litres were recovered. The persons gathered there disclosed the name of owner of the

Patna High Court CR. MISC. No.15552 of 2020(2) dt.14-05-2020 2/2 house as Chitrangan Bhagat and also disclosed the name of Vijay Pankiyar (petitoner) and Sujal Mahto, who succeeded to flee away.

Learned counsel for the petitioner submits that admittedly petitioner is not the resident of P.O. village rather his name has been disclosed due to dirty village politics. Further submission is that, in fact, petitioner is accused in similar nature of three other cases due to that reason, he has been implicated in the present case and petitioner is in custody since 08.01.2020 after surrender before the trial court.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Sitamarhi, in connection with Bathnaha P.S. Case No. 255 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
