JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 147,148,149,341,323,324,427 and 504 of the Indian Penal Code and section 27 of the Arms Act.

It is alleged that the accused persons including the petitioner came and started laying foundation of a temple in front of the house of the informant and on protest being made, co accused Keshav Tiwari fired, thereafter the petitioner assaulted with Khanti on the head of the informant and snatched gold chain. It is submitted by learned counsel for the petitioner that in the background of land dispute the accusation has been levelled and there is counter version of the occurrence.

Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Brahmpur (Nainijor) P.S. Case No. 74 of 2015 pending in the court of learned C.J.M., Buxar.

This application is disposed of with the aforesaid observation/direction.
