The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341/323/504/354/34 of the Indian Penal Code and section 3(1) (xi) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

It is alleged that two boys tried to ravish the informant when protest was made the informant was abused and dragged. The accused persons also gave life threatening to the informant. The petitioner was identified by the informant. It is submitted by learned counsel for the petitioner that FIR was registered on 24.02.2015 but it reached to the court of learned 1st ADJ on 27.05.2015, which suggests that the same

Patna High Court Cr.Misc. No.28375 of 2015 (2) dt.24-07-2015 2/2 has been registered with antedating and from the FIR, it appears that no injury was caused to the informant. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Naubatpur P.S. Case No.90 of 2015, pending before the learned 1st Additional District and Sessions Judge-cum Special Judge, SC/ST Act, Patna.

With the above observation, this application is, accordingly, disposed off.
