The petitioner seeks bail in a case registered for offences under Sections 30 (a) and 35 of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 25 litres of country made liquor was recovered from the gunny bag which was being carried by the petitioner on his head. Petitioner claims that he is having clean antecedent and is in custody since 06.10.2017.

Considering the facts and the circumstances of the

Patna High Court Cr.Misc. No.53796 of 2017(2) dt.09-11-2017 2/2 case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-IIcum-Special Judge, Excise, Rohtas at Sasaram in connection with Sasaram (T) Darigaon P.S. Case No. 1448 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
