2. The petitioner, who was appointed as Junior Accounts Clerk in the Sone Barrage Division, Indrapuri and after rendering satisfactory service of more than 40 years, superannuated on 31st of January, 2007, is aggrieved by the fact that despite his being qualified for being paid 1st and 2nd A.C.P. as well as the M.A.C.P., he has been denied the same.

Patna High Court CWJC No.5765 of 2019 dt.12-04-2019 2/2 He has approached this Court for a direction to the concerned authorities to make payment of the financial progression to which he is entitled and also for fixation of pension accordingly.

Considering the prayer of the petitioner, this Court deems it appropriate to direct him to prefer an application / representation before the Chief Engineer, Sinchai Srijan Water Resources Department Dehri District - Rohtas, detailing his grievances within a period of four weeks from today, who on receipt of the same, shall, after verifying the facts and the eligibility of the petitioner for being paid the benefits of 1st and 2nd A.C.P. and M.A.C.P., pass orders in accordance with law within a further period of six weeks thereafter. If the claim of the petitioner is found to be tenable, necessary sequel order shall also be passed within the aforesaid period. With the aforesaid observation / direction, this petition stands disposed off.
