JUSTICE SANJAY PRIYA ORAL ORDER 27-03-2019 This application has been filed for modification of the order dated 19.2.2018 passed in Cr. Misc. no. 62349 of 2017, by which petitioner has been granted anticipatory bail in connection with complaint case no. 903C of 2015 to the satisfaction of learned ACJM IV, Munger.
The petitioner has not surrendered even after passing of aforesaid order.
The instant modification application has been filed by petitioner for extension of time to surrender on the ground that he was suffering from fever. But no supporting document has been filed. From the record it appears that petitioner has earlier
Patna High Court CR. MISC. No.14546 of 2019(2) dt.27-03-2019 2/2 also filed modification application being Cr. Mic. no. 27148 of 2018, and the petition was allowed by order dated 2.5.2018. The petitioner was given four weeks further time to surrender by that order.
Therefore, this court is not inclined to pass any order to further modify the order dated 19.2.2018 passed in Cr. Misc no. 62349 of 2017.The petitioner is directed to surrender and make prayer for regular bail before the Court which shall be considered and disposed of in accordance with law without being prejudiced by the present order.
