JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 467, 468, 471, 120B/34 of the Indian Penal Code.

Prosecution case is that the informant entered into an agreement with Birbal Yadav for purchase of a piece of land appertaining to plot no.59, Khata no.231 situated at Patna measuring an area of one bigha when Rs.4,50,000/- was paid through cheque and Rs.50,000/- was given in cash. The petitioner is one of the witnesses in the agreement.

It is submitted by learned counsel for the petitioner that the never any such agreement has been brought on record. There is nothing on record to show that in whose name the cheque was issued and to whom the cash was given. Moreover, similarly

No.24037 of 2016 (2) dt.30-05-2016 2/2 situated co-accused Murari Kumar, who is also a witness to the occurrence, has been granted anticipatory bail by a co-ordinate Bench of this court vide Criminal Miscellaneous No.18267 of 2016. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Begusarai, in connection with Barauni P.S. Case No.149/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
