The petitioner seeks bail in a case registered under Sections 379/411 of the Indian Penal Code and 25(1-b)a, 26/35 of the Arms Act.

The prosecution case in short is that on secret information, the informant reached near Sukhiya bridge along with police party. The police party nabbed accused persons on chase and on search, Rs. 3300/- was recovered from possession of coaccused. The stolen motorcycle was also recovered from possession of co-accused.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 21-10-2018. Charge

Patna High Court CR. MISC. No.16859 of 2019(3) dt.19-06-2019 2/2 sheet has already been submitted. One stolen motorcycle is said to have been recovered from common possession of the accused persons. So far as recovery of arms is concerned, the same is said to have been recovered from possession of co-accused Raja Ram. There is no compliance of Section 100 Cr.P.C. On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Bounsi P.S. Case No. 239 of 2018.
