Petitioner seeks bail in connection with Brahmpur P.S. Case No. 200 of 2018 registered for the offence punishable under sections 341, 342, 354(A) and 504 of the Indian Penal Code and Section 12 POCSO Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Victim girl was not examined under section 164 Cr.P.C. and there is no any injury report on the record. Petitioner is in custody since 14.05.2018.

Learned Addl. P.P. appearing for the State and the learned counsel appearing for the informant opposes the prayer for bail and submits that there is specific allegation against this petitioner. Further, during investigation materials have come

Patna High Court Cr.Misc. No.43110 of 2018(2) dt.20-07-2018 2/2 against this petitioner. Criminal history of this petitioner is also not good.

Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court is not inclined to grant bail to the petitioner. His prayer for bail is, therefore, rejected. However, petitioner may renew his prayer bail after framing of charge.
