2.The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Sangrampur P.S. Case No. 188 of 2024 instituted for the offence punishable under Sections 310(2) and 312 of the Bharatiya Nyaya Sanhita, 2023.
3. The case of the prosecution is that the informant is having a shop of medicine which is owned by Jay Kumar Singh and he is his staff. On 18.07.2024 at about 2 P.M. he was carrying certain cartons of medicines and a payment diary. As he reached Bhatwaliya Bhawanipur, six persons on three bikes

It is further alleged that one of the miscreants assaulted with knife and another person fired but did not hit him. The miscreants took away the medicines cartons, one diary and rupees one lakh and fifty eight thousand.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. His name has transpired during the course of investigation only on the basis of confessional statement of co-accused Rajnish Kumar recorded by the police, which has no evidentiary value in the eye of law. Nothing has been recovered from the possession of the petitioner. It has also been submitted that Rajnish Kumar has been granted regular bail by this Court vide order dated 23.01.2025 in Cr. Misc. 76632 of 2024.
5. Learned APP appearing for the state has opposed the prayer of bail.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender
Patna High Court CR. MISC. No.17073 of 2025(2) dt.19-03-2025 3/3 in connection with Sangrampur P.S. Case No. 188 of 2024, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, First Class, East Champaran, Motihari subject to the conditions as laid down under section 438(2) of the Cr.P.C.
