2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 323, 385, 493, 376, 504, 506 of the Indian Penal Code.
3. As per the prosecution case, earlier informant was married to one Md. Majahar. Since last one month, she was residing in her parental house where, seeing her alone in the house, this petitioner who was working with her father, established physical relation. On protest, he told that he would be marrying her as her earlier husband is not good one. Petitioner took her to his house where other family members abused and assaulted her and ousted from the house. Accused persons demanded Rs.5 lacs as dowry.
4. Learned counsel appearing for the petitioner
Patna High Court CR. MISC. No.18057 of 2025(2) dt.10-04-2025 2/2 submits that from the FIR itself it is evident that petitioner and informant were major when both of them became intimate. It is further submitted that after institution of the case, petitioner has married with the informant vide Nikarnama contained in annexure P/2 to the bail petition. Both of them are now enjoying conjugal life. Petitioner claims clean antecedent.
5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Araria in Palasi Police Station Case No. 284/2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
