JUSTICE PARTHA SARTHY ORAL ORDER 06-01-2023 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has prayed for grant of regular bail in a case registered under sections 394 and 379 of the Indian Penal Code and section 27 of the Arms Act to which section 302 of the Indian Penal Code was added later.

As per the prosecution case, four unknown accused persons looted the motorcycle of the informant's sister-in-law and in the said occurrence the son-in-law of the informant also sustained gunshot injury.

It is submitted by learned counsel for the petitioner that the FIR was registered against four unknown. In course of investigation the motorcycle in question was recovered from co-

Referring to the order of the learned Court below it is submitted that the name of the petitioner transpired in the confessional statement of the said co-accused Sonelal Kumar who has himself been enlarged on bail vide order dated 23.8.2021 (Annexure-2) passed in Cr. Misc. no. 10391 of 2021. The petitioner is in custody since 3.7.2020. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the grant of bail to co-accused Sonelal Kumar on whose confessional statement before the police that the name of the petitioner transpired together with the petitioner having remained in custody for 2 years 6 months since 3.7.2020, the petitioner is directed to be enlarged on bail in connection with Kalyanpur P.S. Case no. 55 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court of C.J.M. Motihari, East Champaran.
