2. The learned APP at the outset submits that from perusal of para-34 of the case diary it would manifest that the Investigating Officer of the case has issued notice under Section 41(A) of the Cr.P.C. to the accused persons including the petitioners.

3. Further submits that para-35 of the case diary records that 'Chowkidar' got the notice under Section 41(A) of the Cr.P.C. served on all the inmates of the house.

4. The learned APP thus submits that since petitioners are availing the benefit of Section 41(A) of the Cr.P.C. as such

Patna High Court CR. MISC. No.21892 of 2024(3) dt.18-07-2024 2/2 for the present they don't have any apprehension of arrest.

5. The learned counsel appearing on behalf of the petitioners is not in a position to rebut the said submission of the learned APP.

6. Considering the submission made by the learned APP and the fact that notices under Section 41(A) of the Cr.P.C. has been issued to the petitioners, as such the Court is not inclined to entertain the instant anticipatory bail application, accordingly, the anticipatory bail application is rejected.
