JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 409 of the Indian Penal Code.

It is alleged that the petitioner being ex Chairman of PACCS failed to hand over charge of the relevant documents including the licence register of PDS shop and cash amount of Rs.200000/-.

It is submitted by the learned counsel for the petitioner that informant is the present Chairman of PACCS and the petitioner had lodged an Election Case challenging the election of the informant, hence the present case has maliciously been lodged. It is further submitted that the petitioner undertakes to deposit

Patna High Court Cr.Misc. No.28468 of 2015 (2) dt.24-07-2015 2/2 Rs.200000/- before the learned court below within three months which will be invested in some fixed deposit scheme in connection with the present case which will be subject to the result of the case. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

On deposit of 50% of the aforesaid amount before the learned court below, let the above named petitioner be released on provisional anticipatory bail for three months in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saran at Chapra in connection with Garkha P.S. Case No. 81 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.

The provisional bail of the petitioner will be confirmed by the learned court only on deposit of rest 50% of the due amount within three months.
