JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-05-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 392/34 of the Indian Penal Code.
The prosecution case is that informant's mobile, cash of Rs. 3000/- and driving license were robbed leading to registration of the F.I.R against unknown. It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner and petitioner's name sprang up on confession of co-accused Sudhir Kumar.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with
Patna High Court Cr.Misc. No.24507 of 2016 (2) dt.31-05-2016 2/2 Khizarsarai P.S. Case No. 31 of 2015, pending in the Court of learned Additional Chief Judicial Magistrate, IIIrd, Gaya. With the observations above, the application stands disposed off.
