JUSTICE BIRENDRA KUMAR ORAL ORDER 03-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with S.T. No.461 of 2016, arising out of Nawada Town P.S. Case No.215 of 2016, a case under Sections 302/364/34 of the Indian Penal Code, pending in the Court of Additional Sessions Judge-V, Nawada. Allegation against the petitioner is that he gave dagger blow to Manoj Ram as a result whereof he died. Petitioner is in custody since 05.04.2016.

Earlier prayer for bail was refused on 02.05.2017 in Cr. Misc. No.20586 of 2017 vide Annexure-1 with direction to the learned trial-court to expedite the trial and liberty to the petitioner to renew the prayer for bail after six months if the trial is

Patna High Court Cr.Misc. No.59813 of 2017 (3) dt.03-01-2018 P2/ not concluded in the meantime.

The petitioner has stated on oath that several prosecution witnesses including wife of the deceased have been examined and none had supported the allegation. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
