The petitioner is apprehending her arrest in a case registered for the offence punishable under Section 498A of the Indian Penal Code.
The prosecution case, in brief, is that the husband of the complainant, at the instance of the petitioner started demanding Rs.50,000/-, motorcycle, colour T.V and Fridge from the complainant and due to non-fulfillment of the said demand, she was subjected to cruelty and torture and at the instigation of the petitioner, the husband of the complainant ousted the complainant from her matrimonial home.
Patna High Court Cr.Misc. No.24066 of 2016 (2) dt.16-06-2016 2/2 Learned counsel for the petitioner submits that the petitioner is second wife of the husband of the complainant and, as such, she has got no role in the commission of the alleged occurrence.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on anticipatory bail in the event of arrest of surrender before the learned Court below within a period of four weeks from the date of receipt of the order on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Katihar in connection with C.A. Case No. 2400 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Gopal Prasad, J.) Rajiv/Amit U T
