JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 18-07-2017 Heard learned counsel for the petitioner and learned counsel for the State.

Pursuant to the order dated 03.07.2017, the District Education Officer, Sitamarhi has appeared in person. It is stated by the learned counsel for the State that the entire dues amount of pension has already been sanctioned, authorized and credited in the account of the petitioner bearing Account No. 449710100001027 in the Bank of India, Runnisaidpur Branch.

The aforesaid contention of the learned counsel for the State has not been controverted by the learned counsel for the

Patna High Court CWJC No.15259 of 2014 (5) dt.18-07-2017 2/2 petitioner.

In that view of the matter, since the payment of dues amount of pension has already been made to the petitioner, the writ application is disposed of with liberty to the petitioner to raise the issue of interest for the delayed payment by filing a suit before the court of competent jurisdiction.

Since the matter has already been disposed of, the District Education Officer, Sitamarhi is discharged from the liability of the personal bond.
