The petitioner apprehends his arrest in Bakhtiyarpur P.S. case No. 191/2018 registered under Section 392 of the IPC. Later on the case was converted u/s 395 of the IPC. The informant lodged the case against unknown for looting of his two mobile sets and other articles. The learned counsel for the petitioner submits that during the course of investigation two persons, namely, Shahjahan Alam and Sarfaraz Alam were apprehended and looted mobile was recovered from their possession. They confessed their guilt and disclosed the name of the petitioner and other accused persons. Similarly situated accused, Shamshad Alam has already been granted anticipatory bail by a coordinate bench of this court vide order passed in Cr. Misc. No.

Patna High Court CR. MISC. No.15347 of 2020(2) dt.10-09-2020 2/2 15703/2019 and the case of petitioner stands on the same footing.

Taking into consideration the facts that, of course, name of the petitioner was surfaced in the case during the course of investigation in the confessional statement of coaccused from whose possession looted mobile was recovered but co-accused Shamshad Alam, whose name was also surfaced in the case in the same confession of the co-accused has already been granted anticipatory bail, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S. case No. 191/2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
