JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-09-2022 At the outset, learned counsel for petitioner seeks permission to add alias name of petitioner in the cause title. Permission is granted and the same be done during course of the day.
Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner apprehends his arrest in Siwan Mahila P.S. Case No. 32 of 2021, registered for the offences punishable under Section 498A and other allied sections of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act. As per the prosecution case, all the FIR named accused persons including petitioner committed torture and harassment due to non-fulfillment of demand of dowry.
Patna High Court CR. MISC. No.20917 of 2022(2) dt.05-09-2022 2/2 It is submitted that petitioner is mother-in-law of the informant. The thrust of accusation is against husband of the informant who has already been granted bail by this court. Counsel for Informant however vehemently opposed the prayer for bail.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Siwan in connection with Siwan Mahila P.S. Case No. 32 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
