JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,307 and 504/34 of the Indian Penal Code. It is alleged that petitioner no. 1 assaulted with farsa on the head of the informant when he fell down, petitioner no. 2 assaulted with iron rod. The motive of the occurrence is alleged to be land dispute.

It is submitted by the learned counsel for the petitioner that for the occurrence of 3.4.2015 the FIR has been registered on 18.4.2015 and the petitioners side lodged Marhowrah P.S. Case No. 83 of 2015 on 5.4.2015 for the occurrence of 3.4.2015. It is further

Patna High Court Cr.Misc. No.28316 of 2015 (2) dt.23-07-2015 2/2 submitted that the injury has been found to be simple. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the delayed lodging of the case, injury being found to be simple and the case lodged by the petitioners side was earlier in point of time, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Saran at Chapra in connection with Marhowrah P.S. Case No. 104 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
