The petitioner seeks regular bail in connection with Bihiya PS case no. 252 of 2018 registered for the offence punishable under Section 395 of Indian Penal Code. The allegation is regarding the police having received information that some miscreants were preparing to commit crime and upon a raid being conducted, the petitioner and other accused persons were apprehended whereafter the petitioner is said to have been remanded in the present case. The learned counsel for the petitioner submits that neither any T.I. parade has been conducted not any recovery has been made. It is further submitted that the petitioner has been falsely implicated in the present case. It is further
Patna High Court CR. MISC. No.17182 of 2019(2) dt.02-04-2019 2/2 submitted that although the petitioner is an accused in four other cases but they are old cases and he is on bail in the said cases. The petitioner is said to be languishing in custody since 27.10.2018.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 5th Bhojpur, Ara in connection with Bihiya PS case no. 252 of 2018.
