JUSTICE SANJAY PRIYA ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner and learned counsel for the State.

This application has been filed for modification of the order dated 29.11.2011 passed by a coordinate Bench of this Court in Cr. Misc. 28833 of 2011.

The prayer for anticipatory bail of the petitioner was earlier allowed by a coordinate Bench of this Court vide order dated 29.11.2011 passed in Cr. Misc. 28833 of 2011 with a direction to remain physically present before the court below till disposal of the case.

The petitioner made prayer to exempt him from appearing in the court below on each and every date of trial as per the aforesaid order.

Considering the facts and circumstances of the case,

Patna High Court Cr.Misc. No.3848 of 2017 (2) dt.10-02-2017 2/2 this Court does not find any justifiable reason for modification of the aforesaid order dated 29.11.2011 passed by a coordinate Bench of this Court in Cr. Misc. 28833 of 2011.

The modification application is accordingly disposed off.
