Petitioner seeks regular bail in connection with Hussainganj P.S.Case No.312 of 2017 instituted for the offences under Sections 272, 273, 308 of the Indian Penal Code and Section 30, 36, 38, 41 (1) and 62 of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 518 litres illicit wine from the house of one Balindra Singh.

The learned counsel for the petitioner submits that no recovery has been affected from the conscious possession of the petitioner or from the premises of the petitioner. It is further submitted that the petitioner has a clean antecedent and he is in

Patna High Court Cr.Misc. No.59276 of 2017 (2) dt.22-12-2017 2/2 custody since 30.10.2017.

Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner has got a clean antecedent, I direct the petitioner, named above, to be released on regular bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge,2nd -cum- Special Judge (Excise), Siwan, in Hussainganj P.S.
