The petitioner seeks regular bail in connection with Kesariya P.S. Case No. 227 of 2017 for the offences registered under Sections 25(1-b)a and 26 of the Arms Act. The prosecution case in short is that the informant i.e. the S.H.O. of Kesariya Police Station has recorded his self statement in which he has stated that upon secret information the house of the petitioner was raided and search was made from where one country made pistol and two mobiles were recovered. The learned counsel for the petitioner submits that the petitioner is innocent and he is in custody since 06.8.2017 and as far as the other two cases pending against him are concerned, in
Patna High Court Cr.Misc. No.53533 of 2017 (2) dt.09-11-2017 2/2 one final form has been submitted and in the other he is on bail. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail only after completion of six month's custody with effect from 06.08.2017.
Accordingly, it is directed that the petitioner be enlarged on regular bail immediately upon completion of six month's custody with effect from 06.08.2017 subject to such conditions as may be imposed by the learned court below.
