The petitioner apprehends his arrest in Civil Lines (Gaya) P.S. case No. 54/2016 under Section 341, 323, 406, 420, 504/34 of the Indian Penal Code.

The informant alleged that the petitioner is owner of Wipo Tele Services, a company which had taken the contract for preparing Adhar Card. The petitioner and others have approached the informant for preparing Adhar Card for which the petitioner was ready to pay Rs. 17/- per Adhar Card to the informant. It is further alleged that petitioner and others handed over two machines for which Michael Kumar received Rs. 1,40,000/- as security money. The informant alleged that petitioner and others took the machines but did not return the security money nor paid the money for preparing Adhar Card.

It is submitted that the informant has not returned the machines to the petitioner, therefore, security money was not

Patna High Court Cr.Misc. No.24829 of 2016 (3) dt.11-08-2016 2/2 returned. The petitioner gave receipts of security money and the informant also gave receipts of machines but the informant did not produce any receipt for returning the machines. There was arbitration clause for the agreement but the informant did not give any notice. Similarly situated accused Michael Kumar has already been granted anticipatory bail vide order passed in Cr. Misc. No. 18789 of 2016.

Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Civil Lines P.S. Case No. 54 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
