The petitioner seeks bail in anticipation of his arrest in connection with Islampur P. S. Case No. 308 of 2018 dated 08.09.2018 instituted for the offences under Sections 147, 149, 341, 342, 323, 504, 506, 325, 307 and 379 of the Indian Penal Code.

Though the informant has received as many as 10

Patna High Court CR. MISC. No.17004 of 2019(2) dt.26-03-2019 2/3 injuries but all the injuries have been opined to be simple in nature.

Learned counsel for the petitioner has submitted that 10 persons have been made accused including the petitioner and it does not appear to be plausible that 10 persons would assault one person and no grievous injury would be caused to him. It has further been submitted that because of the dispute between two adjoining villages, the petitioner has been made accused in the present case. The petitioner does not have any animosity with the informant and the story of the informant of having prevented the petitioner and others from manufacturing / brewing liquor is absolutely incorrect.

Regard being had to the aforesaid facts and also taking into account the clean antecedents of the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like
