In this case, the petitioner is seeking anticipatory bail in connection with G.O. Excise Case No. 792 of 2018 arising out of Ghanshyampur P.S. Case No. 139 of 2018 registered for offence punishable under section 30(a) of the Bihar Prohibition Excise Act, 2016.

The police recovered seven litres of illegal liquor. The petitioner has criminal history.

In such view of the matter, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the petitioner surrenders before the court below, the court below without being prejudiced by the order of

Patna High Court CR. MISC. No.17405 of 2019(2) dt.26-03-2019 2/2 this Court, will take decision in accordance with law preferably on the same day.
