The petitioner seeks bail in connection with Kothi P.S. Case No. 14/2016 dated 18.04.2016 instituted for the offence under Section 386 of the Indian Penal and Section 17 of the C.L.A. Act.

Rs. 5 lacs was demanded as ransom from the informant. The petitioner is not named in the F.I.R. and his name came on the confession of one Arun Kumar Yadav, who has been granted bail by a co-ordinate Bench of this Court on 20.03.2017 passed in Cr. Misc. No. 7421/2017.

Learned counsel for the petitioner submits that because of the criminal antecedents of the petitioner, the police has ensured that his name is also taken in the confessional statement. He has

No.48057 of 2017 (3) dt.28-11-2017 2/2 further drawn the attention of this Court to the order dated 20.03.2017 of granting bail to co-accused Arun Kumar Yadav (Annexure-2), whereby Arun Kumar Yadav, having criminal antecedents against him, has been granted bail. Taking into account the custody of the petitioner which is from 09.01.2017, this Court is inclined to grant bail to the petitioner.

The petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Kothi P.S.
