2. The learned counsel for the petitioner has submitted that, though the bail petition of the petitioner was earlier rejected, vide order dated 21.08.2024 in Cr.Misc. No. 80011 of 2023, but the petitioner is renewing his prayer for bail on the ground that charges were framed a year ago, but till date not a single witness has been examined. The learned counsel has also submitted that co-accused Deepak Kumar and Vishunu Kumar have been granted bail by the co-ordinate Benches of this Court in Cr.Misc. No. 13810 and Cr.Misc. No. 79898 of 2024.

3. On the other hand, the learned APP for the State has opposed the prayer for bail of the petitioner.

4. Considering the above facts and circumstances, let

No.18704 of 2025(3) dt.27-06-2025 2/2 the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, Motihari, East Champaran in Sessions Trial No. 1203 of 2023, arising out of Turkuliya P.S.Case No. 569 of 2023, subject to the conditions that the petitioner shall cooperate in the disposal of trial and make himself available on each and every date fixed at the trial, and if he fails to appear on two consecutive dates unless he is prevented by extremely adverse circumstances, the court below shall be at liberty to cancel his bail bond.
