JUSTICE SHIVAJI PANDEY ORAL ORDER 11-02-2015 Heard learned counsel for the petitioners and the State. In this case the petitioners are seeking anticipatory bail in connection with Kotwali (Barari) P.S.Case No.750 of 2010 for the offences punishable under Sections 341, 323, 337, 504/ 34 of the Indian Penal Code.

There is case and counter case from both the sides. The allegation has been made that from the top of the roof there was throwing stones over the other side. Earlier a case was instituted under section 307 IPC in which policed after investigation submitted final form but the learned C.J.M. differing with the charge-sheet submitted by the police took cognizance under the aforesaid section.

In view of the facts and circumstances in the event of

No.36981 of 2014 (2) dt.11-02-2015 2/2 the petitioner's arrest/ surrender before the court below within four weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Kotwali (Barari) P.S.case No. 750/2010, subject to the conditions as laid down u/s 438(2) Cr.P.C.
