JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-05-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 307 of the Indian Penal Code and Section 27 of the Arms Act. The prosecution case is that in the background of a dispute with regard to the construction of P.C.C road co-accused Santosh Singh fired upon the informant with country made pistol causing injury to him. The petitioner Satish Singh fired upon the mother of the informant Mintu Devi causing injury on the finger of the left hand, co-accused Sheoje Singh also fired in the air.

It is submitted by learned counsel for the petitioner that though in the F.I.R it is alleged that petitioner only caused injury to the mother of the informant but during investigation even the injured suggested that firing was only made by this petitioner which suggests the malicious nature of accusation.

Patna High Court Cr.Misc. No.24397 of 2016 (2) dt.31-05-2016 2/2 A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the fact that injury alleged to have been caused by the petitioner is on non-vital part of the body coupled with a statement in para 3 of the petition that petitioner has no criminal antecedent, it is a case for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Udwant Nagar P.S. Case No. 57 of 2016, pending in the Court of learned Chief Judicial Magistrate, Bhojpur at Ara. With the observations above, the application stands disposed off.
