Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section

Patna High Court CR. MISC. No.28225 of 2021(2) dt.02-02-2022 2/3 30(a), 41(1)(2) of the Bihar Prohibition & Excise Act. There is recovery of 160 litres of country made liquor from the house of Vijay Rai.

It is submitted by learned counsel for the petitioner that petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner. A statement has been made in para 3 of the petition that petitioner is accused in two other cases of similar nature apart from the present case.

Considering the fact that petitioner is accused in two other cases of similar nature apart from the present one, this Court is not inclined to grant anticipatory bail to the petitioner.

However, if the petitioner surrenders within a period of four weeks from today and pray for regular bail, the same may be considered by the learned Court below, keeping in view the facts stated above and without being prejudiced by the order of this Court.
