2. The petitioner apprehends his arrest in connection with Jamui P.S. Case No. 613 of 2023 registered under Sections 341, 323, 308, 379 and 504/34 of the Indian Penal Code.
3. In the First Information Report, it is alleged that petitioner along with other accused persons involved in illegal mining of sand. Due to said illegal mining and excavation, the Government exchequer has incurred a loss of Rs. 86,13,000/- .
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case merely on suspicion. Further submission is that petitioner has neither the owner nor the driver of the seized vehicles. There is no specific allegation against the
Patna High Court CR. MISC. No.19993 of 2024(3) dt.30-04-2024 2/2 petitioner which shows that he is involved in the said illegal mining of sand.
5. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 613 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
