JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-08-2022 The learned counsel for the contemnors submits that the arrears of 90% pension has been paid to the petitioner as well as the current pension is also being paid to the extent of 90%, however 10% balance amount of pension has not been paid on account of non-fixation of the same by the Accountant General, Bihar, Patna despite the fact that the District Treasury Officer, Begusarai as also the District Programme Officer (Establishment) Begusarai have visited the office of the Accountant General, Bihar, Patna as also have written letters for fixing the final pension of the petitioner herein. This conduct of

Patna High Court MJC No.984 of 2021(6) dt.17-08-2022 2/2 the Accountant General, Bihar, Patna, if true, is deprecated and he is directed to fix the final pension of the petitioner forthwith. In such view of the matter, this Court directs the Accountant General, Bihar, Patna to fix the final pension of the petitioner within a period of one week from today, failing which, he shall not draw his salary. Communication to this effect shall be sent by the Chief Secretary, Government of Bihar, Patna to the Office of the Accountant General, Bihar, Patna to do the needful. It is needless to state that the balance amount of 10% pension shall be paid to the petitioner, within a period of two weeks from today, failing which, the petitioner shall be at liberty to file an I.A. in the present case for revival of the contempt petition and initiating contempt proceeding against the Chief Secretary, Government of Bihar, Patna.

The contempt petition stands disposed off on the aforesaid terms.
