ANJANA MISHRA ORAL ORDER 22-05-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Dumra P.S. Case No.27 of 2018 (G.R. No. 223 of 2018) for allegedly having committed the offence under Sections 461 and 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the FIR is against unknown person, one Nandan Jha, who was arrested, has taken the name of the petitioner in his confessional statement. Learned counsel further submits that the confessional statement made before the police by the co-accused has no evidentiary value and also that similarly situated co-accused Manchi Pandey @ Manjit Pandey @ Ritesh Kumar Pandey

Patna High Court CR. MISC. No.19309 of 2019(3) dt.22-05-2019 2/2 whose name has also been taken in the confessional statement has since been extended the privilege of anticipatory bail in Cr.Misc. No.2622 of 2019, vide order dated 21.01.2019. Considering the aforementioned facts and circumstances and that there being no recovery from the possession of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Dumra P.S. Case No.27 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
