The petitioners seek bail in anticipation of their arrest in connection with Alinagar P.S. Case No. 98 of 2019, dated 02.10.2019, instituted for the offences under Sections 420, 406 and 120(B)/34 of the Indian Penal Code.
Petitioner No. 1 is the farmer, whereas petitioner No. 2 is a ward-member of Hanuman Gram Panchayat.
It has been submitted on behalf of the petitioners that the allegation against them is of misappropriating the money meant for beneficial programmes of the Government. It has further been submitted that during the course of investigation, it came to light that none of the beneficiaries have complained about the money not being given to them.
Regard being had to the nature of accusation and the tenor of investigation as has been suggested by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest/surrender before the Court below within a period of six weeks from today, are directed to be released on bail on their furnishing bailbonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-
Divisional Judicial Magistrate, Benipur, Darbhanga in connection Alinagar P.S. Case No. 98 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
