Petitioners are apprehending their arrest in a case under Sections 419, 420, 120B, 467, 468, 471, 472, 477A, 406 and 409 of the Penal Code lodged against one Santosh Kumar Yadav whose house was raided by the informant Police Officer who seized many education certificates, voter-lists and with reference to
Patna High Court Cr.Misc. No.35196 of 2014 (2) dt.13-03-2015 2/3 the certificates it is said that said Santosh Kumar Yadav is the education/degree mafia. It is further submitted on behalf of the petitioners that the own brother of said Santosh Kumar Yadav, namely, Pawan Kumar Yadav has been admitted to the privilege of bail in the event of arrest by another Bench of this Court. In this background it is submitted that petitioner Indu Devi, who is Mukhiya of the Gram Panchayat, Suresh Chandra Manjhi, who is Panchayat Secretary have hardly any connection with Santosh Kumar Yadav, yet they have been made accused in the present case. Antecedent of petitioner Indu Devi is absolutely clean. In the circumstances, she is directed to be released on bail on furnishing bond of Rs.
5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in connection with Nagar (Town) P.S. Case No. 45/2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. So far petitioner Suresh Chandra Manjhi is concerned, he is accused in two other cases, one of which is under Sections 409, 420 of the Penal Code i.e. for misappropriation of fund.
Patna High Court Cr.Misc. No.35196 of 2014 (2) dt.13-03-2015 3/3 involvement with the education scam is not found, he be released on bail, preferably on the same day. (V.N. Sinha, J) P.K.P.
