JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Parbatta Police Station Case No. 51 of 2016 registered for the offences punishable under Sections 420, 120B, 201/34 of the Indian Penal Code.
Petitioner was working as Panchayat Secretary and failed to deposit the relevant documents relating to appointment of Panchayat teachers in spite of specific directions of higher officials as well as a Division Bench of this Court. Submission on behalf of the petitioner is that as a matter of fact, the required documents had not been given to the petitioner at the time of taking charge but, subsequently, petitioner
Patna High Court Cr.Misc. No.24619 of 2016 (2) dt.13-06-2016 2/2 after hectic search, traced out the relevant documents and deposited the same before the District Education Officer, Khagaria which is evident from perusal of Annexure-3 to the petition. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 1st Khagaria in Parbatta Police Station Case No. 51 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C.
