The petitioner apprehends her arrest in a case under Section 406, 420 of the Indian Penal Code and under section 3 (1) (x) of the SC & S.T. Act.
The informant alleged that one Arun Kumar used to come to his house for imparting tuition. He persuaded him to deposit money in the Weard Company. The informant along with Arun Kumar went to the office of the Company where Shobha Kumari, the petitioner, Sudhir Prasad, Pravin Kumar, Guddu Sharma and Bigan Prasad were sitting. On persuasion of Arun Kumar the informant deposited Rs. 80,000/- in the name of his wife but later on he came to know that the Company was closed. It is submitted that petitioner is simply an employee
Patna High Court Cr.Misc. No.35553 of 2015 (3) dt.30-10-2015 2/2 of the Company. She did not persuade the informant to deposit the money.
Considering the facts aforesaid and the fact that petitioner is a lady, the above named petitioner, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Kotwali P.S. Case No. 172 of 2015 (G.R. No. 2113/15), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
