2. Petitioner seeks bail, who is in custody since 18.10.2020, in connection with Sessions Trial No. 173 of 2021 arising out of Gamhariya P.S. Case No. 155 of 2020, F.I.R. dated 15.09.2020 registered for the offences punishable under Sections 302/120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. Earlier the bail petition of the petitioner was rejected vide order dated 24.06.2023 passed in Cr. Misc. No. 8671 of 2023.

4. Vide order dated 13.03.2024 a report was called for with regard to the stage of the trial. Report dated 28.03.2024

Patna High Court CR. MISC. No.19812 of 2024(4) dt.04-07-2024 2/2 of the learned Trial Court reveals that out of five chargesheeted witnesses, four witnesses have already been examined and only one witness (I.O.) is yet to be examined.

5. Considering the aforesaid facts and circumstances of the case and in view of the report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail in connection with Sessions Trial No. 173 of 2021 arising out of Gamhariya P.S. Case No. 155 of 2020 pending in the Court of learned Additional Sessions Judge-VIII, Madhepura.

6. Prayer is refused.

7. However, the learned Trial court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Ibrar//- U T
